Terms of Service

1. Acceptance

By accessing or using Peak Performance ("the Service"), you agree to these Terms. If you do not agree, do not use the Service. The Service is operated by Roy Thande ("we", "us").

2. Not a medical device — important disclaimer

⚠ Peak Performance is not a medical device.

The Service is a personal productivity and self-reflection tool. It records self-reported wellbeing scores and generates pattern-based observations. It does not:

  • diagnose any physical or mental health condition;
  • provide medical advice, clinical assessment, or treatment recommendations;
  • replace care from a qualified healthcare professional.

If you are experiencing a mental health crisis, thoughts of self-harm, or any other medical emergency, contact emergency services or a crisis line immediately. Do not rely on this Service in an emergency.

3. Eligibility

You must be at least 18 years old to use the Service. By using it, you represent that you meet this requirement.

4. Your account

Access is via magic link sent to your email address. You are responsible for keeping your email account secure. Notify us immediately at roy.thande@gmail.com if you suspect unauthorised access to your account.

5. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in violation of any applicable law;
  • attempt to circumvent authentication, access another user's data, or probe for vulnerabilities without written permission;
  • send automated requests that place disproportionate load on our infrastructure;
  • use the Service to generate, train, or evaluate machine learning models without our prior written consent.

6. Your data and content

You own all check-in data and notes you enter. By using the Service, you grant us a limited licence to process and store that data solely to operate and improve the Service for you. We do not sell your personal data or use it to train external AI models.

You can export your data at any time (Settings → Export my data) and delete your account (Settings → Delete my account).

7. Availability and modifications

We provide the Service on a best-efforts basis. We may modify, suspend, or discontinue any part of the Service at any time. We will give reasonable notice of material changes where practicable.

8. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including any decisions you make based on Service outputs. Our total liability to you for any claim will not exceed the amount you paid us in the 12 months preceding the claim (which, for a free beta, is zero).

9. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the Service in violation of these Terms.

10. Governing law

These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya, except where mandatory consumer protection laws in your jurisdiction require otherwise.

11. Changes to these Terms

We may update these Terms. Continued use of the Service after changes take effect constitutes acceptance. Material changes will be emailed to registered users at least 14 days in advance.
